Welcome to RUCker. These Terms govern your use of the RUCker mobile app, and the services provided by Vehicle Testing NZ Limited (VTNZ). By clicking "I Accept", you agree to these terms.1. The Purpose of RUCker

By using this App, you acknowledge and agree that:
Location Tracking: We collect GPS, mileage, and motion data (accelerometer/gyroscope) from your device and/or the vehicle.
Background Tracking: If enabled, the RUCker track's location even when closed, to ensure RUC mileage is recorded accurately.
Data Sharing: Trip information including start/end times and locations is available to the vehicle owner(s), your Fleet Manager (if you have one), and VTNZ. We also provide mileage information to Waka Kotahi (NZTA) and trusted third‑party partners to help process your RUC.
2025 Privacy Rights: In accordance with the Privacy Act 2025, you have the right to access any personal information we hold about you and request corrections if the data (such as a recorded trip) is inaccurate.

3. Your Responsibilities
Safe Driving: You must comply with all NZ road safety laws. VTNZ and its partners are not liable for any incidents resulting from distracted driving.Accuracy: You agree to provide correct odometer readings to be recorded for the purpose of purchasing Road Users through RUCker.Device Care: You are responsible for keeping your mobile device charged. VTNZ and/or its partners are not responsible for RUC non-compliance caused by your device running out of battery or having GPS disabled.
4. Report Access
Private vehicle owners have access to their own reports of vehicle-usage and driving-events (heavy braking or speeding).Fleet Managers can access vehicle‑usage and driving‑event reports (heavy braking or speeding) for safety and tax compliance.
5. Limitation of Liability
VTNZ provides this service "as is" during this trial period. While we strive for 100% accuracy, we are not liable for any government fines, RUC penalties, or "off-road" refund denials resulting from GPS drift, signal loss, or app errors. Final responsibility for valid RUC lies with the vehicle operator/owner.6. Ending Use
You can stop tracking by logging out or uninstalling the App. If you are looking to delete

1. Introduction
This Privacy Policy is issued by VTNZ (“we”, “us”, “our”), the provider of the RUCker mobile application and website. RUCker helps users track vehicle travel, monitor mileage, and manage Road User Charges (RUC).
By using RUCker, you agree to this policy. We manage all personal information in accordance with the New Zealand Privacy Act 2020 and the Privacy Amendment Act 2025.2. What We Collect and Why
RUCker is a telematic solution provided by Vehicle Testing NZ Limited to assist Customers with Road User Charges (RUC) obligations in New Zealand. We collect information necessary to provide RUC management and driving insights.
A. Account & Profile Information
What: Name, email address, mobile number, and vehicle details – including your registration number(s).
Why: Account information is necessary to create your account, provide customer support, and associate vehicles with your profile.
B. Telematics & Geolocation Data
What: GPS coordinates, IP address, WiFi/Bluetooth signals, and "Activity Monitoring" data (gyroscope, accelerometer).
Why: To enable automatic trip detection, calculate accurate distance for RUC compliance, and detect driving events (e.g., hard braking).
Background Tracking: If you allow background location access, the app can automatically record your RUC mileage for you. You can change this anytime in settings, but some RUC features may not work as expected.
C. RUC & Odometer Data
What: Photo evidence and/or recording of odometer readings, calculated mileage, and current or owed RUC statuses.
Why: To calculate/forecast RUC requirements and submit Road User Charges Licence Application (RUCLA) forms on your behalf.

D. Indirect Collection (New Zealand Privacy Amendment Act 2025)
What: We may collect information about your vehicle or its registered owner
from third parties, such as the Waka Kotahi (NZTA) Motocheck API.
Why: To verify vehicle details and ensure RUC compliance. We take reasonable
steps to ensure you are notified when we collect information from these thirdparty
sources.
3. How We Share Your Information
We do not sell your personal data. We only share information to operate the service:Government Agencies: We disclose vehicle and mileage data to Waka Kotahi (NZTA) or authorized entities to purchase and administer your RUC licences.Service Providers: We share data with trusted partners for cloud hosting, payment processing, RUC label printing, and technical analytics.Legal Requirements: We may disclose information if required by law, such as for criminal investigations or regulatory audits.Anonymized Data: We may share aggregated, non-identifiable data for market research or statistical analysis.
4. Data Storage, Security, and Retention
Security: We use ISO 27001-aligned standards and cloud-based infrastructure to protect your data from unauthorized access.Overseas Storage: Data may be stored on secure servers outside New Zealand. We ensure these providers offer privacy protections comparable to New Zealand law.Retention:Active Accounts: We keep your data for as long as your account is open, even if you haven’t used it for a while.RUC Records: Telematics and mileage data are retained for as long as necessary to meet legal RUC auditing and compliance requirements.
Breach Notification: If a privacy breach occurs, we will notify you and take appropriate steps to keep you informed, including contacting the Privacy Commissioner when required.
5. Your Rights and Choices
Access & Correction:You have the right to access the personal information we hold about you and request that any inaccuracies be corrected.
Since RUC is a financial product, it is your responsibility to ensure that your recorded mileage data is accurate.
Marketing: You can opt out of newsletters or promotional materials via the "unsubscribe" link or app settings. You will still receive "service" emails (e.g., RUC expiry alerts).Account Deletion: You can request account deletion by emailing rucker@vtnz.co.nz.
Note: Uninstalling the app does not delete your account. You must contact us to ensure all data is permanently removed.
